Privacy Policy

1. Purpose

This Policy sets out APS responsibilities in relation to the collection, use, disclosure and handling of personal information in compliance with the Federal Privacy Act 1988.

Personal information is defined as information or an opinion about an individual whose identity is apparent or can reasonably be ascertained from the information or opinion. It includes information, which is written, oral or electronic.

2. Collection of Personal Information

APS will only collect personal information if it is necessary for our business of providing staffing solutions.

We may collect your personal information:

  • directly from you; and / or
  • from third parties, including but not limited to previous or current employers or their representatives, trade unions, police, licensing authorities, government and regulatory authorities, medical practitioners and health service providers, rehabilitation service providers, insurers, Education Providers and/or financial institutions.

The information that APS may collect can include - name, address, telephone numbers, next of kin, educational details, employment history, skills and competencies, eligibility to work in Australia, criminal history, union membership, ability to meet inherent requirements of a position, driver licences, license histories, bank details, tax file numbers and/or superannuation details.

APS will collect this information with your consent and to the extent that APS are permitted by law to do so.

3. Use and Disclosure of Personal Information

APS uses the personal information to ascertain an individual’s suitability for permanent or temporary employment with APS or placement at Host Employers.

We may use your personal information to:

  • ascertain your employment requirements;
  • assess your suitability for employment with APS and/or placement at Host Employers
  • verify your employment history, qualifications, suitability for employment at APS or placement at Host Employers;
  • obtain or provide reference checks about you;
  • provide you with information about prospective employers;
  • pay you for your services;
  • meet Occupational, Health and Safety requirements;
  • investigate an incident, if you are injured at work, or any complaint;
  • assist your rehabilitation, and / or
  • in any other matter that you have requested and consented for APS to provide.

We may also disclose your personal information:

  • organisations which assist us in providing human resource services, including information technology service providers and rehabilitation service providers;
  • professional advisers, including accountants, auditors and lawyers;
  • financial institutions;
  • superannuation funds;
  • medical practitioners and other health professionals;
  • insurers;
  • trade unions;
  • police;
  • Educational providers;
  • Government and regulatory authorities;
  • our related companies, and/or
  • any other external provider relevant to your employment with APS to which you have requested and consented for APS to provide.

APS will not use, or disclose personal information to any organisation or entity, for any purpose other than as specified above, unless APS have your consent.. If you consent, and then change your mind, you can ask us not to use your personal information for that purpose again.

APS may also use and disclose personal information for any other purpose authorised under the Privacy Act 1988.

4. Security of Personal Information

APS will protect the confidentiality and security of your personal information. APS will destroy your personal information in accordance with our obligations under the Privacy Act 1988 and other relevant laws and quality service standards.

5. Accuracy and Access to Personal Information

You can request access to the personal information APS hold about you. If it is incorrect or out of date, APS will correct or update it. Your rights to access your information and our rights to refuse access are set out in the Privacy Act 1988.

You should make your request to us in writing. In your request, you should clearly identify the personal information that you require. APS will verify your identity to ensure that APS do not provide personal information to anyone who is not entitled to that information.

APS may charge you an administration fee for the cost of providing you with access to the personal information APS hold about you.

6. If you do not provide us with your Personal Information

We need your personal information to provide our services. If you do not give us this information we may not be able to provide these services.
